Canada National Do Not Call List and Telemarketing Rules (CRTC) Telecommunications Act ss. 41 to 41.7, current to 2026-09-30; CRTC Rules compilation modified 2014-03-31
The telemarketing rules for calls and faxes to Canadian consumers: Telecommunications Act ss.
41 to 41. 7 and the CRTC Unsolicited Telecommunications Rules (the National Do Not Call List Rules, the Telemarketing Rules and the Automatic Dialing-Announcing Device Rules, consolidated in one compilation).
This is a separate regime from CASL: CASL covers written electronic messages, while the Telecommunications Act s. 41(2) leaves out messages that are CEMs under CASL s.
6, and CASL s. 6(8) leaves out interactive two-way voice calls, faxes and voice recordings.
Telemarketers must register with the National DNCL operator and pay fees, must not call numbers on the list unless an exemption applies, and must keep their own internal do-not-call list. Exemptions in s.
41. 7(1) cover registered charities, calls to people with an existing business relationship who have not asked to be left alone, political parties and candidates, survey-only calls and newspaper subscription calls; an existing business relationship lasts 18 months after a purchase, lease or rental and 6 months after an inquiry or application (s.
41. 7(2)).
Calling hours in the Rules are 9:00 a. m.
to 9:30 p. m.
on weekdays and 10:00 a. m.
to 6:00 p. m.
on weekends, in the consumer's local time, and stricter provincial hours still apply. Administrative monetary penalties are up to $1,500 for an individual and $15,000 for a corporation per violation, and each day is a separate violation (ss.
72. 01 and 72.
03). The Rules compilation was read through a summarizing fetch (the CRTC site refuses direct downloads), so Part and section numbers should be confirmed by a person against the compilation.
Tiers: TELEMARKETER for those who place the calls, and CLIENT for organizations that hire a telemarketer. General information, not legal advice.
