Pennsylvania privacy, security and AI (sector tiers) Sector rules read 23 Oct 2026

Pennsylvania state-level privacy, security and AI rules for organizations that hold information about people in Pennsylvania, organized as one framework with seven sector tiers.

Pennsylvania has no comprehensive consumer privacy statute in force: House Bill 78 (2025-26 session) passed the House on 1 October 2025 and was still before the Senate on 23 October 2026, so this framework rests on the sector and subject-matter laws that do apply. General tier: the all-party consent rule for recording calls (18 Pa.

C. S.

ss. 5703, 5704(4), 5725), the digital forgery offence (s.

4101. 1, in effect 5 September 2025), and AI tools under existing law, because Pennsylvania has no AI statute for businesses.

Insurance tier: the Insurance Data Security Act (Act 2 of 2023, 40 Pa. C.

S. Chapter 45, effective 11 December 2023): risk assessment, written information security program, board oversight, annual certification by domiciled insurers, third-party service provider oversight (Insurance Department date: 11 December 2025) and notice to the Insurance Commissioner within five business days of a determination.

Finance tier: the breach Act’s deemed-compliance route for financial institutions; no Pennsylvania-specific information security rule for Department of Banking and Securities licensees could be verified, and the tier says so. Health tier: the secrecy rules for HIV-related information (Act 148 of 1990), mental health treatment records (Mental Health Procedures Act s.

111) and drug and alcohol treatment records (Act 63 of 1972 s. 8), alongside HIPAA.

Transport tier: driving-record disclosure limits (75 Pa. C.

S. s.

6114, 67 Pa. Code Chapter 95) and the 24-hour destruction rule for private parking lot registration data (s.

3356). Public sector tier: the Right-to-Know Law (65 P.

S. 67.

101 et seq. ), including records held by contractors (s.

506(d)), and the Commonwealth’s information technology policies as published in 2025 and 2026. Programs tier: confidentiality of public assistance and Medicaid information (55 Pa.

Code Chapter 105), unemployment compensation information (34 Pa. Code s.

61. 25) and criminal history record information (18 Pa.

C. S.

Chapter 91). The Breach of Personal Information Notification Act has its own framework, PA_BPINA, and is not repeated here.

General privacy and AIFor any organization with Pennsylvania residents’ information. No comprehensive consumer privacy law is in force (House Bill 78 pending), so this tier covers recording consent for calls and sessions (18 Pa.C.S. ss. 5703, 5704(4), 5725), digital forgery (s. 4101.1), and how existing law applies to AI tools. Exemptions in s. 4532 cover only ss. 4512 to 4516.—
Finance and lendingFor banks, credit unions, lenders, mortgage and consumer credit licensees, money transmitters and securities firms. Covers the breach Act’s route for financial institutions, the credit-monitoring duty, and customer-instruction fraud. Health informationFor providers, facilities and their IT support in Pennsylvania. State secrecy rules that sit beside HIPAA: HIV-related information (Act 148 of 1990 s. 7), mental health treatment records (Mental Health Procedures Act s. 111) and drug and alcohol treatment records (Act 63 of 1972 s. 8).—

How Lavawall® helps you get to Pennsylvania privacy, security and AI (sector tiers) compliance

Most of Pennsylvania privacy, security and AI (sector tiers) comes down to technical controls you have to run and prove: keeping systems patched, hardening configuration, detecting breaches early, backing up what matters, controlling access, and keeping evidence that all of it actually happened. Lavawall® runs those controls across Windows, macOS, Linux, and Microsoft 365 / Google Workspace from one console, maps them to Pennsylvania privacy, security and AI (sector tiers), and tracks your posture continuously instead of once a year at audit time.

  • Assess your current state against Pennsylvania privacy, security and AI (sector tiers) in the Lavawall GRC module, with the questionnaire and control set built in.
  • Remediate the gaps with the same platform — automated patching, configuration fixes, backups, and access review — not a separate project.
  • Evidence everything with timestamped, exportable records auditors, insurers, and clients accept.
