Pennsylvania Breach of Personal Information Notification Act Act 94 of 2005, as amended 2022 and 2024

Pennsylvania Breach of Personal Information Notification Act, Act of December 22, 2005 (P.

L. 474, No.

94), 73 P. S.

2301-2330, in force 180 days after enactment. It applies to any entity doing business in Pennsylvania, including individuals and businesses, State agencies, political subdivisions, counties, public schools and municipalities.

Two amending acts matter. Act 151 of 2022 (approved 3 November 2022, effective 180 days later) added determination and discovery, health insurance information, usernames and email addresses with passwords, seven-business-day notice for State agencies, counties, public schools and municipalities (s.

3(a. 1), (a.

2)), State agency contractor duties, and Commonwealth encryption and data storage policies (ss. 5.

1, 5. 2).

Act 33 of 2024 (approved 28 June 2024, effective 90 days later) added concurrent notice to the Attorney General when more than 500 Pennsylvanians must be notified (s. 3(c.

1)), notice to nationwide consumer reporting agencies when more than 500 persons are notified (s. 5), and one free credit report plus 12 months of credit monitoring where a name is combined with a Social Security number, bank account number, or driver’s licence or State ID number (s.

5. 4).

Notice is due without unreasonable delay after a determination, meaning verification or reasonable certainty that a breach occurred. HIPAA covered entities and business associates in compliance with HIPAA are deemed compliant (s.

5. 3); financial institutions following the federal interagency guidance are deemed compliant (s.

7(b)(1)); entities under the Insurance Data Security Act are exempt from the Attorney General notice (s. 3(c.

2)). Only the Attorney General can enforce it, as an unfair or deceptive practice (s.

8). Bills to amend it again (House Bill 997) had passed the House but not the Senate on 23 October 2026.
